Employment and Labour

A badly drafted contract could have serious implications on your business. When hiring an employee, employers should at the very least, be aware of the basics of employee rights and benefits. Hiring an employee may also come with other obligations, such as registering with the Employees Provident Fund and Social Security Organisation, minimum wage requirements, minimum annual leave entitlements, sick leave entitlements and so on.

A typical example on the misconception when it comes to employment issues are that since employee can resign from their position anytime by giving the required notice or payment of wages in lieu of notice then naturally the employees’ employment can also be terminated by the employer just by giving either the minimum notice provided by the law or the notice stated in the Employment Contract or payment of wages in lieu of notice. By doing so, the employers are in fact exposing themselves to the risk of being sued for unfair dismissal by the disgruntled employees. Employers must bear in mind that any termination of employment of its employees must be done in a fair way and with “just cause and excuse”.

We must also add that having good policies in your business from the start can save you a lot of heartbreak and implementation issues in the long run. The importance of good drafting also extends to company’s policies. Company’s policies should always be clear and consistent and be put down in writing in places such as the Employees’ Handbook. Virtually everyone postpones writing a Will. Many view the process as giving away the ownership of our property or even a taboo to even talk about Will. Whatever the reason may be for putting off the drafting of a Will, many people do not realize that writing one actually prevents what is feared. In fact, a Will may be the most important document that you ever write, because it allows you to select the persons who will receive what you own when you are no longer around. A Will can protect your minor children and old age parents’ interest while making sure that someone you trust will be the one helping to administer your estate and ensure your estate goes to your loved ones in accordance with your wishes written in the Will.

A Will’s importance is clear regardless of your personal situation. Without a will, you have no control about the distribution of your property after your death or the persons involved in administering the estate. A local court makes those decisions, and it has no authority to deviate from the law. In essence, the court steps into your shoes and makes all of the decisions for you whether or not it is what you want.

This can be easily avoided with proper planning. By creating your Will now, you can always add to the provisions or alter the document as your life evolves. It’s important to review your current Will every five years to ensure that it’s up to date and still reflective of your future wishes.
